STANDARD WARRANTY


 

Terms and Conditions

The sale or rental of Refurbished Equipment shall be made upon the following terms and conditions. Any additional or different terms and conditions proposed by Customer will not be binding upon Tucker Electronics (hereinafter "Company") unless specifically agreed to in writing by the Company's authorized representative.

I. EQUIPMENT COVERED

  • Unless otherwise stated, the Warranty shall cover All Refurbished Equipment either sold or rented by Tucker Electronics, and specifically excludes Refurbished Equipment sold or rented "As-Is". The Company reserves the right to sell or rent Refurbished Equipment without a Warranty or under a Limited Warranty.

II. STANDARD WARRANTY PERIOD

  • Unless otherwise stated, the Standard Warranty Period shall begin on the Equipment Shipping Date and expires one hundred and eighty (180) days thereafter. Any change in the Standard Warranty Period shall be stated on the Customer Invoice.
  • The Company may offer Refurbished Equipment for Sale or Rental under a Limited Warranty, whereby the Limited Warranty shall have a warranty period of thirty (30) days.

III. WARRANTY COVERAGE

  • The Company warrants the Refurbished Equipment against defects in materials and workmanship, including all electrical and mechanical parts required for the proper and functional operation of the Refurbished Equipment, unless otherwise stated below:
    1. Technical Assistance is provided by our Lab personnel prior to returning equipment for repair.
    2. The Company shall, at its option, either repair the equipment, supply a replacement (subject to availability), make a price adjustment or credit Customer's account upon an approved return of the equipment
    3. ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE ARE SPECIFICALLY EXCLUDED AND DISCLAIMED.
    4. The Company shall not be liable for any loss or damage whatever by reason of its failure to discover, report, repair or modify latent defects or defects inherent in the design of the equipment.

IV. WARRANTY EXCEPTIONS

  • The Warranty SHALL NOT COVER ANY COSMETIC DEFECTS which do not affect the functional operation of the Refurbished Equipment. All Refurbished Equipment shall be cleaned and re-painted when necessary. In addition, all non-instrument labels shall be removed, and any missing or damaged hardware shall be replaced or repaired, including bezels, frames, latches, handles, knobs connector jacks, switches, and indicators.
  • Certain products which contain Storage Tubes, Backward Wave Oscillators (BWO), Traveling Wave Tubes (TWT), or any other products deemed a Warranty Exception by the Company shall only be warranted through a Limited Warranty.
  • Additional cost involved in cleaning, repairing or replacing components affected by improper storage and/ or utilization will become the responsibility of the customer.

V. GUARANTEE OF WARRANTY SERVICE

  • Any repair made to the Refurbished Equipment during a warranty period shall be Guaranteed for thirty (30) days, but shall not act to increase the term of the warranty by more than thirty (30) days. An extension of the warranty period shall only cover the Refurbished Equipment's functions or operations affected by the repair. The Refurbished Equipment shall not be re-calibrated unless required as a result of the repair.

VI. WARRANTY CANCELLATION

  • The Warranty shall be made void if upon the Company's inspection it is determined the Customer removed the equipment exterior panels without authorization from the Company.

VII. RETURNING EQUIPMENT UNDER WARRANTY

  • Equipment may only be returned after a Return Material Authorization number is assigned.
  • All Equipment covered by Warranty shall be returned to the Company in Accordance with the Company's Commercial Sales Warranty Procedure. The customer is responsible for all Shipping, Handling, and Insurance Costs related to the shipping of the Refurbished Equipment to the Company. International Customers shall pay all shipping charges, as well as duties and taxes. The Company is responsible for all Shipping, Handling, Insurance Costs (duties and taxes when applicable) related to the shipping of the Refurbished Equipment to the Customer.

VIII. LIMITATION OF LIABILITY

  • The Company's liability on any claim of any kind, whether based on contract, warranty, tort, strict liability or otherwise, for any loss or damage arising out of or connected with or resulting from the supply of equipment hereunder, shall in no case exceed the price paid by the Customer to the Company for such equipment.

IX. COMPLETE AGREEMENT

  • The terms and conditions contained herein represent the complete agreement between the Company and Customer, and no modification, amendment, revision, waiver or other change will be binding on the Company unless agreed to in writing by the Company's authorized representative.

X. FREIGHT DAMAGE POLICY

Outbound Shipments

If equipment is received in damaged condition, it is the customer's responsibility to notify the carrier (before leaving your facility if possible). Contact Tucker's Customer Service Department immediately, and keep all packaging or claim could be denied. We will provide assistance as required in filing the claim.

Inbound Shipments

Customers are responsible for any loss or damage to equipment shipped back to Tucker.

A Return Material Authorization Number must be assigned prior to returning equipment, contact our Customer Service Department for additional information.
